Fujitsu-Nanya agree to settle patent dispute

TOKYO, JAPAN & TAIPEI, TAIWAN: Fujitsu Microelectronics Ltd and Nanya Technology Corp. have signed a patent license agreement containing licensing terms with financial arrangements to resolve patent disputes between the companies.

Under the agreement signed on September 2, 2008, Fujitsu Microelectronics parent company Fujitsu Ltd will withdraw its request to have an injunction enforced against the import of Nanya Technology's DRAM products into Japan and will terminate its legal proceeding against Nanya Technology in the United States. Nanya Technology will also terminate its legal proceedings in Japan and the United States. Other terms of the agreement are not disclosed.

"We are pleased to have reached a settlement with Nanya Technology," said Shigeru Fujii, corporate senior executive vice president of Fujitsu
Microelectronics. "Fujitsu Microelectronics has a long track record of successful research and development of semiconductors, with over 10,000 patents around the world in the LSI field, including semiconductor memories. We are happy with this result and the respect accorded to our patent portfolio. We consider our intellectual property, including our patents, to be important company assets. Accordingly, we will continue to leverage our intellectual property to support our business."

"Nanya is pleased with the settlement reached with Fujitsu Microelectronics Limited and can now continue to focus on expanding its leadership in research and development in the DRAM industry. The settlement concludes three years of litigation between the parties and allows Nanya to direct its resources in technology development and services to our customers," said Dr. Pei Lin Pai, vice president and spokesman of Nanya Technology.
