A
patent is a privilege granted by a state for the territory
of this state, to exploit exclusively a novel invention
susceptible of industrial application.
The word "patent" has two
meanings: it is a privilege granted to an inventor over
some product and/or process applicable to the industry
as an exclusive right to exploit an invention, and in
addition it is the legitimate document certified by
the government via the IMPI, that recognizes the attributes
of the inventor and the rights imparted. Said document
is called title of patent or title of protection. The
privilege granted through a patent is the exclusive
right to exploit an invention during a limited term
of twenty years, meaning that nobody can make "commercial
use" of the patented product or process without
the formal consent of the owner of the patent.
We consider as invention everything
arising from intellectual creation which allows the
transformation of matter or energy in nature for human
exploitation by way of the immediate satisfaction of
a concrete need. Processes and products having industrial
applications are included among inventions.
